Katy Drug Crimes Lawyer

Drug laws can be enforced strictly, at both the state and federal levels. It’s also true that sometimes circumstances can result in innocent people being swept up into drug arrests and others being charged with more severe crimes than is appropriate. When that happens, a Katy drug crimes lawyer has to be on hand to help make things right.

Cory Roth Law Office believes in the principle of innocence until proven guilty and we’ll fight with all the legal tools available to us on behalf of our clients. From our Katy office, we serve people across Fort Bend County and Harris County. Call today at (713) 322-5733 or contact us online to set up a consultation.

3 Types of Drug Crimes in Texas

The possible drug offenses could be as basic as being caught with marijuana on one’s person or as serious as running an international heroin cartel. At these extremes, and everywhere else in between, drug crimes will generally fall into three categories…

Possession: As the name of the charge suggests, this means the defendant had the drugs anywhere from on their person to within reaching distance to under their control. Another facet of possession is the issue of intent to sell. Possession over and above certain quantities can be seen as indicators that the defendant had the drugs for the purpose of selling them. Intent to sell can bring more serious charges.

Manufacturing: The making of illegal drugs is also a crime, regardless of whether one consumes or profits from the product. Furthermore, it is illegal to sell the chemicals and equipment necessary to make the drugs. Although in the latter case, it’s incumbent on the prosecution to prove the defendant knew the reason for the purchase.

Trafficking: The phrase “trafficking” can bring to mind images of a worldwide ring and that is certainly one possible reason for a trafficking charge. But in reality, trafficking covers all sale of illegal drugs, right down to the street dealer who works a single neighborhood.

Depending on the specific drugs involved, the quantities and other circumstances, drug charges can be either felonies or misdemeanors. But it should be noted that even misdemeanor offenses can bring jail time if convicted.

The consequences of conviction are serious, but a sharp and vigorous Katy drug crimes lawyer has several avenues of defense available. Call Cory Roth Law Office at (713) 322-5733 or contact us online to set up a consultation.

Defenses Against Drug Charges

While there is no one-size-fits-all defense strategy, the Fourth Amendment to the United States Constitution can be a good place to start when it comes to drug crimes. The 4th Amendment is what protects us from unreasonable search and seizure by the authorities.

Physical evidence is vital for a prosecution and obtaining the drugs–or a paper trail of transactions–might be what makes or breaks a case. But the police have to obtain that evidence lawfully.

That starts with getting a search warrant. Even beyond that, it calls for asking why a search warrant was issued to begin with. Judges can’t simply issue warrants and hope for the best. There has to be probable cause–something that suggests strongly that evidence will be at the place that was searched.

Furthermore, confessions have to be validly obtained. There are limits on police behavior in the interrogation room. When these limits are violated or when warrants are not lawfully obtained, the Katy drug crimes attorney has the basis for requesting that all evidence obtained by these illicit means be dismissed. If a jury can’t hear or see this evidence, there may well be no case.

The Fourth Amendment is just one method of questioning the validity of drug charges. Defendants deserve a lawyer who will listen to everything that is unique about their case and that diligently explore all avenues of defense, contesting the prosecution every step of the way.

That’s what we do at Cory Roth Law Office. We don’t roll over for prosecutors and we don’t take them at their word. We demand ironclad evidence that was lawfully obtained because that’s what the American system of justice requires.
